Warranty Limitations
There are no warranties which extend beyond the Tangent limited warranty. Tangent disclaims all other warranties, express or implied, regarding the products, including any implied warranties of availability, reliability, usefulness, merchantability, fitness for a particular purpose or non-infringement.
Limitations of Remedy
Customer's exclusive remedy for any defective product is limited to the repair, replacement of the defective Product. Tangent may elect which remedy or combination of remedies to provide at its sole discretion. This warranty requires the return of defective products in accordance with Tangent's Return Material Authorization ("RMA") procedures. Unauthorized return, (ones for which an RMA has not been issued) will be returned to Customer at Customer's expense. Tangent shall have a reasonable time after determining that a defective product exists, to repair or replace the defective product. Tangent's replacement product under its limited warranty may be manufactured from new and/or refurbished used parts. All parts removed for replacement during any repairs under this warranty will become the property of Tangent. While performing warranty services, Tangent may at its discretion modify the hardware of the product to improve its reliability or performance, at no cost to Customer. The warranty period is not extended if Tangent repairs or replaces a warranted product or any parts. The terms and conditions of this limited warranty may be subject to change without notice, such changes will not be retroactive.
Limitations of Damages
Tangent's entire liability for any defective products shall in no event exceed the price paid for the defective product. This limitation applies even if Tangent cannot or does not repair or replace any defective product.
Tangent has no liability for general, direct, indirect, consequential, incidental or special damages resulting from the use of the product, its accompanying software and documentation.
