FRCP email archiving has become essential in all business today. There is a need for archiving those email messages now as outlined in laws and regulations that went into effect in the US in 2006. The Federal Rules of Civil Procedure have created mandates that call for the regulation of all electronic communication within a business setting. The messages and their attachments must be kept intact in their original form and stored in such a way that tampering is impossible.

The reasoning behind these laws makes sense. It provides a way for the courts to use messages and electronically sent documents in legal cases. The fact that they are tamper-proof makes the messages good and allowable evidence. Many situations are served by the FRCP rules. Judgments, trials, disclosures, pleas and motions, and more are now covered.

The most recent additions to the rules deal with the storage and how it is arranged in the archives. The information must be kept in such a way that it is easily and quickly found for discovery in a legal case. Financial institutions, healthcare companies, and public entities were previously required to keep such records. Now all companies are required to do so.

The simple backup system that most companies use is thought to be adequate. Backup files are stored on the company's server most often. The common timeframe for retention is 90 days. This is not what FRCP means by email archiving.  The proper way to put the communication in storage is to file it separately from the company's main operations server.

An appliance that is used for this purpose retrieves the messages and all accompanying data from the email servers, no matter which ones are used, and the information is sorted and stored at the same time. This is more efficient than standard backup because corruption of the files is highly unlikely, and they cannot be tampered with. They are saved in their original forms and stored with the attachments that came with them. This is the correct way to store them according to the law.

In litigation cases there is a reasonable right to discovery of information that the opposing side may have. In order to maintain fairness in court proceedings for both sides, the court orders all relevant documents and communications to materialize in their original form and be proven to be free from tampering. Anyone who has searched for an old email message or document knows that without a good and efficient search feature it can take hours, days, or perhaps weeks to find what you are looking for. The time limits imposed by judges are not necessarily going to accommodate that sort of time.
